Our Maryland Lawyer Explains How Mass Torts Work
When we talk about mass torts, we are generally referring to an MDL – MultiDistrict Litigation. This is a group of cases consolidated under a federal trial court judge. An MDL forms when the U.S. Panel on Multidistrict Litigation approves the mass tort and consolidates the cases for pre-trial motions and the discovery process.
An MDL then proceeds to select several bellwether trials in the District Court as the first cases to proceed to trial. These trials allow both sides to try out their evidence and see how a jury reacts but do not apply universally to all cases in the MDL. When bellwether trials go in the favor of the plaintiffs, global or tiered settlement offers are more likely. Any plaintiff who does not accept a settlement can return their case to the original jurisdiction for a jury trial, though usually that’s a last resort.
